Council on open legislative procedure<\/h2>\n<h2 class=\"PRPara1\"><img decoding=\"async\" class=\" alignright size-full wp-image-11280\" style=\"margin: 5px; border: 2px solid #616b60; float: right;\" src=\"http:\/\/www.access-info.org\/wp-content\/uploads\/ECJ_0.jpg\" alt=\"ECJ_0\" width=\"270\" height=\"195\" \/><\/h2>\n<p class=\"PRPara1\"><em>22 March 2011<\/em>: The General Court of the European Union today found that the Council of the EU wrongly refused to disclose the identity of countries taking positions on reform of the EU\u2019s access to documents rules.<\/p>\n<p class=\"PRPara1\">Ruling on an application brought by Access Info Europe, the Court found that the Council had \u201c<em>in no way demonstrated<\/em>\u201d how publication of the country names would \u201c<em>seriously undermine its decision-making process<\/em>\u201d.<\/p>\n<p>The Court stated that \u201c<em>If citizens are to be able to exercise their democratic rights, they must be in a position to follow in detail the decision-making process<\/em>\u201d and that they should \u201c<em>have access to all relevant information<\/em>.\u201d<\/p>\n<p>Decision in <em>Access Info Europe v \/><\/a><\/p>\n<p><!--more--><\/p>\n<p>The Council had asserted that: \u201c<em>If written contributions were made fully accessible to the public \u2026 positions of the delegations <div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-1 hundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-overflow:visible;--awb-flex-wrap:wrap;\" ><div class=\"fusion-builder-row fusion-row\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-0 fusion_builder_column_1_1 1_1 fusion-one-full fusion-column-first fusion-column-last fusion-column-no-min-height\" style=\"--awb-bg-size:cover;--awb-margin-bottom:0px;\"><div class=\"fusion-column-wrapper fusion-flex-column-wrapper-legacy\">[would] become entrenched, since those delegations would lose some of their ability \u2026 to justify before their public a compromise solution, which may differ from their initial position<\/em>.\u201d<\/p>\n<p>The Court responded that \u201c<em>By its nature, a proposal is designed to be discussed \u2026 not to remain unchanged \u2026<\/em>. <em>Public opinion is perfectly capable of understanding that the author of a proposal is likely to amend its content subsequently<\/em>.\u201d <\/p>\n<p>Countering the argument put forward by the Council that: \u201cIf delegations were deprived of the chance of having calm discussions \u2026 it would make it difficult for the Council to move the revision of the regulation forward,\u201d the Court noted that: <em>\u201cit is in the nature of democratic debate that a proposal for amendment of a draft regulation \u2026 can be subject to both positive and negative comments on the part of the public and media.\u201d<\/em><\/p>\n<p>The Court\u2019s ruling comes a day after Access Info Europe published \u201c<em><a href=\"http:\/\/www.access-info.org\/wp-content\/uploads\/Secret_State_of_EU_Transparency.pdf\" target=\"_blank\">The Secret State of EU Transparency Reforms<\/a><\/em>\u201d which demonstrates the need for greater openness in the Council if the public is to follow and participate in the EU legislative process.<\/p>\n<p><em>\u201c<\/em><em>The judgment and the case illustrate that <\/em><em>political debate is essential before legislation is adopted\u201d<\/em>, said <strong>Helen Darbishire<\/strong>, Executive Director of Access Info Europe. \u201c<em>This ruling means that the European public will be better informed about and have a say in the decisions that affect our everyday lives<\/em>,\u201d<\/p>\n<p><strong>Michael Cashman<\/strong> MEP, Rapporteur on Public Access to EU Documents remarked that \u00ab<em>This judgement should be welcomed by everyone who believes in openess and transparency, and holding governments accountable for what they vote in the secrecy of Council Meetings. The judgement reinforces the case I have made for enhancing the public&#8217;s access to the documents of the European Union, only that way are governments made accountable.<\/em>\u00bb<\/p>\n<p><strong>Heidi Hautala<\/strong>, MEP and European parliament rapporteur on implementation on access to documents regulation stated that \u00ab<span id=\"_marker\"><em>I salute Access Info&#8217;s great victory of openness against secrecy. Now it must be clear for everyone where the problem lies: EU Member States do everything they can to prevent citizens from participating in decision-making. There can be no democracy without such a right. It is tragicomical that this sad state of the EU was revealed by Access Info&#8217;s legitimate request to learn of the positions of 27 governments on public access to information!
