{"id":21940,"date":"2016-02-08T13:13:56","date_gmt":"2016-02-08T12:13:56","guid":{"rendered":"http:\/\/www.access-info.org\/?p=21940"},"modified":"2018-11-13T10:04:13","modified_gmt":"2018-11-13T09:04:13","slug":"austria-draft-foi-law-falls-short-of-international-standards","status":"publish","type":"post","link":"https:\/\/www.access-info.org\/es\/2016-02-08\/austria-draft-foi-law-falls-short-of-international-standards\/","title":{"rendered":"Austria: Draft FOI law falls short of international standards"},"content":{"rendered":"<h2>Access Info\/IPI analysis welcomes progress, but urges reforms to better guarantee right to information<\/h2>\n<p><em>Madrid\/Vienna, 8 February 2016<\/em> \u2013 Austria\u2019s draft freedom of information (FOI) law requires significant further reforms in order to meet international standards governing transparency and the right to information, Access Info Europe and the Vienna-based International Press Institute (IPI) said today upon jointly releasing <a href=\"http:\/\/www.access-info.org\/wp-content\/uploads\/Austria_submission_FOI_reform_IPI_AIE.docx\" target=\"_blank\">an analysis of the draft<\/a>.<\/p>\n<p>The analysis, conducted by Access Info, welcomes Austria\u2019s initiative to replace an outdated legal framework that \u201cuntil now has severely restricted access to information held by Austrian public bodies\u201d.<\/p>\n<p>Key weaknesses in the proposed FOI law (<em>Informationsfreiheitsgesetz<\/em>) however, include:<\/p>\n<p><span style=\"color: #e3220e;\"><strong>\u00bb<\/strong><\/span><strong> An overly restrictive definition of \u201cinformation\u201d<\/strong> that would exclude drafts, internal e-mails, notes and other information not deemed to \u201cserve an official or company purpose\u201d.<\/p>\n<p><strong><span style=\"color: #e3220e;\">\u00bb<\/span> An expansive list of exceptions<\/strong> to the right of information that includes exceptions not permitted by international standards and treaties. This broad nature of this list is compounded by the <strong>lack of clear, strongly worded harm and public interest tests<\/strong>.<\/p>\n<p><strong><span style=\"color: #e3220e;\">\u00bb<\/span> The lack of an independent oversight body<\/strong> to oversee implementation of the law, hear appeals and make binding decisions on public authorities to disclose information.<\/p>\n<p><strong><span style=\"color: #e3220e;\">\u00bb<\/span> A unnecessarily lengthy time frame of eight weeks<\/strong> in which public bodies must respond to requests for information, a period that may be extended for a further eight weeks in certain circumstances. The European norm is a maximum of 15 working days.<\/p>\n<p><span style=\"color: #e3220e;\"><strong>\u00bb<\/strong><\/span> While filing a request for information is itself technically free of charge, <strong>a fee applies if a person requests an explanation (ruling) if access to information is denied<\/strong>. This ruling is necessary in order to appeal the decision. In practice, this fee closely amounts to a charge for requesting information and thus conflicts with international standards as well as the overwhelming European norm.<\/p>\n<p><span style=\"color: #e3220e;\"><strong>\u00bb<\/strong><\/span> The <strong>rules for requesting information from state-owned companiesdiffer significantly<\/strong> in comparison to requesting information from public bodies. Most importantly, persons whose request for information is denied by a state-owned company must lodge an <strong>appeal through the civil court system<\/strong>, which may involve prohibitively high costs and substantial risk for the plaintiff.<\/p>\n<p>\u201c<em>At the moment, the transparency reform on the table in Austria is not good enough<\/em>,\u201d stated Andreas Pavlou, RTI Campaigner and Researcher at Access Info Europe. \u201c<em>Austrian legislators must ensure that their reform package is in line with the European and international standards on the right to information \u2013 only then will Austrian citizens be able to hold to account their public officials or those operating with public funds, or to participate in decision making processes<\/em>.\u201d Pavlou added.<\/p>\n<p>\u201c<em>We congratulate Austria for taking the much-needed initiative to modernise its legal framework on access to information<\/em>,\u201d IPI Director of Press Freedom Programmes Scott Griffen said. \u201c<em>But given the importance of this step and the fact that Austria is among the last European countries to implement proper access to information legislation, it is important to get it right. The media\u2019s role in informing public debate on matters of government policy can only be realised if journalists have effective access to information held by public bodies. In order to guarantee such access, Austria must ensure that the provisions in the draft law comply with European and international standards<\/em>.\u201d<\/p>\n<p>The 11-page analysis also reviews a draft constitutional reform on access to information that is expected to accompany passage of the FOI law.<\/p>\n<p>Austria\u2019s Constitution currently requires public bodies to observe official secrecy. The changes currently being considered would abolish this provision and establish in its place a constitutional right to information held by public bodies, including state-owned companies. The access to information law is intended to spell out the implementation and limits of this right in practice.<\/p>\n<p>National journalist and civil society organisations had waged a long campaign, led by the NGO Forum Informationsfreiheit, to push the Austrian Parliament toward reforming the country\u2019s outdated secrecy and transparency laws.
