Madrid, 21 March 2016<\/em> – Access Info Europe has urged the European Ombudsman to recommend that the European Union immediately end its current practice of negotiating future legislation in secretive \u201ctrilogue\u201d talks between the Council, Commission and Parliament.<\/p>\n

In a submission to the Ombudsman\u2019s Public Consultation<\/a>, Access Info cited the arguments of the EU\u2019s own Advocate General in the case that led to Access Info\u2019s 2013 victory against the Council before the European Court of Justice:<\/p>\n

\u2018Legislating\u2019 is, by definition, a law-making activity that in a democratic society can only occur through the use of a procedure that is public in nature.[1]<\/div><\/div><\/span><\/blockquote>

\u201cThere are huge concerns about the autocratic way the EU is currently taking decisions \u2013 the current plans to expel refugees being a prime example of that<\/em>,\u201d stated Helen Darbishire, Access Info\u2019s Executive Director.<\/p>\n

\u201cIt is imperative that we have open and accountable law-making in Brussels, something that is clearly required by the EU\u2019s treaties<\/em>,\u201d Darbishire concluded.<\/p>\n

Access Info notes that two arguments have been used by EU officials in favour of having secret trilogue talks: that they are more \u201cefficient\u201d and that they protect law-making from undue lobbying.<\/p>\n

Access Info\u2019s submission notes that lobbyists already have access to EU law-makers \u2013 there are, after all, as many lobbyists as public officials in Brussels \u2013 and that what\u2019s important is to ensure that there is full public debate around and broad participation in the development of any future legislation.<\/p>\n

As the Advocate General stated in his Opinion on Access Info\u2019s court case, it may be \u201ceasier\u201d to hide the legislative process from public scrutiny but this would be undemocratic: \u201cit has never been claimed that democracy made legislation \u2018easier\u2019.\u201d<\/em><\/p>\n
