{"id":36804,"date":"2022-03-30T13:43:19","date_gmt":"2022-03-30T11:43:19","guid":{"rendered":"https:\/\/www.access-info.org\/?p=36804"},"modified":"2022-03-30T14:03:23","modified_gmt":"2022-03-30T12:03:23","slug":"malta-tribunal-case-in-favour","status":"publish","type":"post","link":"https:\/\/www.access-info.org\/es\/2022-03-30\/malta-tribunal-case-in-favour\/","title":{"rendered":"Malta Tribunal decides case in favour of Access Info  and extends the right to information to non-residents"},"content":{"rendered":"<p><em>30 March 2022<\/em> \u2013 <strong>Access Info has successfully defended the right of access to information in Malta, winning a <a href=\"https:\/\/www.access-info.org\/wp-content\/uploads\/Malta_Appeal-Decision-52019.pdf\" target=\"_blank\" rel=\"noopener\">court ruling<\/a> from Malta\u2019s Information and Data Protection Appeals Tribunal that all EU citizens have a right to submit information requests.<\/strong><\/p>\n<p>The case arose from an August 2019 request for data on migration to Malta submitted by an Italian citizen working at Access Info\u2019s Madrid office.<\/p>\n<p>The request was refused by Malta\u2019s Ministry of Home Affairs and National Security on the grounds that she was not a Maltese resident.<\/p>\n<p>Malta\u2019s 2008 Freedom of Information Act says that requesters must be both citizens of Malta or another EU Member State <strong>and <\/strong>have been resident in Malta for five or more years.<\/p>\n<p>Access Info challenged this as contravening Malta\u2019s Constitution and international standards, amounting to a violation of the right to freedom of expression, and constituting discrimination.<\/p>\n<p>In October 2019, the Information and Data Protection Commissioner rejected Access Info\u2019s appeal and upheld the refusal by the Ministry, stating that the legislator\u2019s intention was unequivocally to restrict the right to make information requests to persons with at least five years\u2019 residence in Malta.<\/p>\n<p>With pro bono legal support, we appealed and, on 24 March 2022, the Information and Data Protection Appeals Tribunal decided in favour of Access Info, finding that while the wording of the legislation leaves scope for interpretation, \u201cthe intention of the legislator was never to withhold such information from the EU citizens.\u201d<\/p>\n<p>Helen Darbishire, Executive Director of Access Info said:<\/p>\n<blockquote><p><strong><em>\u201cIt is positive that the Tribunal reviewed the law of other EU Member States in reaching this decision. We hope that it will do the same when considering other FOI appeals in Malta.\u201d<\/em><\/strong><\/p><\/blockquote>\n<p>Rachel Hanna, Legal Researcher of Access Info added:<\/p>\n<blockquote><p><strong><em>\u201cThe refusal to process requests on residency grounds is just one example of Malta\u2019s weak transparency culture<\/em>.<em> This decision by the Tribunal is a positive example of change.\u201d<\/em><\/strong><\/p><\/blockquote>\n<p>The Ministry of Home Affairs and National Security now has to process the original 2019 request and consider it on its merits.<\/p>\n<p>Access Info notes that journalists and civil society continue to have great difficulty obtaining information from government bodies in Malta, with FOI requests often being refused.
